Justification for the award of the contract without prior publication of a contract notice in the Official Journal of the European Union (OJEU):

According to the European Parliament and Council Directive No. 2004/18 / EC, Article 31. 1, point b, the University of Copenhagen believes that only the Thermo-Scientific ‘Helix’ noble gas mass-spectrometer has the required mass resolution (> 750 standard and > 1 500 for the low-mass channel), for optimal separation of isobars. Only Thermo-Scientific offers Farady detector signal amplifiers with 10/13 Ohm measuring resistors (patent pending: — UK Intellectual Property Office Application Number GB1410004.4). This technology expands the dynamic range of the Faraday detector, and is required in our applications for more accurate measurement of small signals. The patent-pending 10/13 Ohm measuring resistors will be able to be used on existing mass-spectrometers from this supplier at the museum.

Lodging of appeals
Precise information on deadline(s) for lodging appeals: If the contracting entity has complied to the procedures according to The Danish act on enforcement of procurement rules, etc. § 4, a complaint regarding the contracting entity entering into contract without prior publication of a contract notice in the Official Journal, must be filed to the Danish Public procurement Appeal Board within 30 calendar days from the day after the day the contract award notice, according to § 7, para. 3, is published, provided that the notice includes justification of the contracting entity's decision to award the contract without prior publication of a contract notice in the Official Journal of the European Union.
Latest at the same time as a complaint is lodged to the Danish Public procurement Appeal Board, the appellant shall in writing inform the contracting entity about the lodging of a complaint to the Danish Public procurement Appeal Board and specify whether the complaint, cf. the Act on enforcement of procurement rules § 12, para. 1, must have suspensive effect on the award decision.
