IV.1.1) Type of procedure
Award of a contract without prior publication of a call for competition in the Official Journal of the European Union in the cases listed below
  • The procurement falls outside the scope of application of the directive
Explanation:

A cryostat is required with a sample vacuum loading system where the experimental wiring is heat sunk in the fridge (and not on a static probe). Due to room-temperature decay of samples a fast initial cool-down (<10 minutes) to below 100Kelvin is essential. It is essential that the system is fully compatible with the sample pucks and loading mechanism of the Oxford Instrument Triton cryostats already installed in the laboratory. Since this is a niche marked there is only 1 supplier of a product meeting the above requirements.

The Danish act on enforcement of procurement rules, etc. defines in § 2, para. 2, point 1, a standstill period of 10 calendar days from the day after the date on which the voluntary ex ante transparency notice is published in the Official Journal of the European Union.
