Wind Power ICS Upgrade — Wind Farm SCADA Systems.
DONG Energy Wind Power A/S intends to award a contract to Siemens Wind Power A/S without prior publication of a contract notice.
The contract covers hardware and services necessary for upgrading the existing central Infrastructure Control System (ICS) on DONG Energy Wind Power A/S' assets.
The upgrade of the central Infrastructure Control System consists of hardware and configurations (servers, gateways) as well as upgrade on the central software.
Upgrade of peripheral equipment hardware and software is not part of the procurement.
To comply with utility best practice within Wind Farm operations, existing ICS systems must be upgraded to most recent versions
The purpose is to upgrade (hardware and software) of the existing wind farm SCADA solution from the original provider of the SCADA solution.
Section IV: Procedure
- The works, supplies or services can be provided only by a particular economic operator for the following reason:
- absence of competition for technical reasons
An entire wind farm' ICS solution consists of a central ICS server, connected to peripheral controllers and terminal units.
On the controller and unit side, there is direct connection to turbines and transmission equipment to manage the power production. The upgrade of Central ICS solution is consisting of new hardware and configurations (servers, gateways etc.), as well as upgrades of the central software.
There is a strong dependency between the central software, hardware and the peripheral technical operation of the turbines and transmissions of the ICS (WTG). It is not technically possible to switch the provider of the Central ICS solution (software and hardware), without having to change the entire ICS solution, including peripheral controllers and units, for the entire wind farm.
At the DONG Energy operated wind farms,cf. section II.1.4) the software in the controllers and the units are proprietary, and specifically built to operate with a central ICS solution from the same provider. This means that the intellectual property rights are owned exclusively by Siemens Wind Power A/S. Thus, another supplier cannot upgrade the central ICS. The only way to change contractor on this procurement, will therefore be to tender for a completely new ICS for the whole of each wind farm
DONG Energy Wind Power A/S has made a calculation of whether it would be commercial attractive to implement a new upgraded ICS solution. A very conservative estimate of the costs associated with implementation of a new upgraded ICS solution on a wind farm (including lost downtime revenue) compared to upgrading the existing ICS solution is more than a factor 10. This estimate is not counting in the significant higher amount of resources needed for a new implementation.
Therefore, DONG Energy Wind Power A/S has within its discretion to decide how to fix the issue at hand decided to upgrade instead of replace the ICS solution.
It is therefore the contracting entity' intend to award the contract to Siemens without prior publication of a contract notice in accordance with article 50, letter c), ii-iii).

The deadlines are provided in Danish act no 492 of 12.5.2010 on enforcement of the public procurement rules, etc. (only available in Danish).
Complaints about that the contracting entity has entered into an agreement according to the §4 procedure must be filed within 30 days from the day after the day where the contracting entity has published a contract award notice that the contract has been entered in to. The complainant must notify the contracting entity in writing of the filling of a complaint with Klagenævnet for Udbud (the Review Board for public procurement) at the latest when he files the complaint with Klagenævnet for Udbud, and the notification must contain information about whether the complaint is filed in the standstill period or not.
