Please note the contract start date is only indicative and is subject to change. Estimated total amount: 37.000.000 USD, Estimated quantities: 31.000 Digital Personal Devices excluding related Accessories and Warranties. The above estimates is indicative, and the aggregated purchases made under the framework agreement may vary from the above estimates. Unforeseen circumstances might occur if for instance new projects, strategic changes or new needs arise. Therefore, the Contracting Entity has decided to also include the following total maximum: Maximum value 44.000.000 USD, total maximum quantities: 37.000 Digital Personal Devices excluding Accessories and Warranties. The highest maximum will prevail. Should the value of the maximum quantity exceed the maximum amount, then the maximum quantity prevails. Should the maximum amount exceed the maximum quantity, the maximum amount prevails. This is because lower unit prices, might lead to increased purchases although, the Contracting Entity has used its best efforts in estimating the quantities and amounts. The above estimates and maximums do not preclude or change the Contracting Entity’s possibilities to make modifications to the Contract, cf article 89 of the Utilities Directive

In accordance with law no. 593, dated 02/06/2016, complaints about the award of a framework agreement must be filed with the Danish Complaints Board for Public Procurement (Klagenævnet for Udbud) within 6 (six) months from the day after the Contracting Entity has notified the affected applicant and tenderers of the award, cf. § 7, subs. 2 in the law mentioned above.” The following text should be used regarding the award of a contract if the contract has been awarded after the publication of a voluntary ex ante transparency notice (“VEAT”): “In accordance with law no. 593, dated 02/06/2016, complaints about the award of a contract following the publication of a voluntary ex ante transparency notice must be filed with the Danish Complaints Board for Public Procurement (Klagenævnet for Udbud) within 30 (thirty) calendar days from the day after the Contracting Entity has published an award notice of the contract in TED. The deadline is counted from the day after the publishing, cf. § 7, subs. 3 in the law mentioned above.

The Ørsted Group establishes new Affiliates on an ongoing basis. Any new Affiliate will also become a Contracting Entity under the Contract, as long as the new Affiliate’s activities are within the usual activities of the Ørsted Group which is to develop, construct and operate offshore and onshore wind farms, solar farms, energy storage facilities, and bioenergy plants, and to provide energy products to its customers.
