In connection with the bid, the Tenderer must submit a duly completed European Single Procure-ment Document (ESPD) regarding the suitability requirements, grounds for exclusion and any sub-contractors or other supporting undertakings. The Tenderer must complete the ESPD in Ethics in accordance with the information requested in section 2.3 of these Tender Specifications. A. Personal situation – Exclusion grounds The Tenderer must use the ESPD to confirm that the Tenderer is not affected by: • The compulsory grounds for exclusion, cf. sections 135-136 of the Danish Public Pro-curement Act. • The voluntary grounds for exclusion below, cf. section 137 of the Danish Public Procure-ment Act. The voluntary ground(s) for exclusion is/are: • Section 137(1), no. 2 of the Danish Public Procurement Act – The Tenderer has been de-clared bankrupt or is undergoing insolvency or winding-up proceedings, where the assets of the Tenderer are being administered by a receiver or by court, where the Tenderer has entered into an arrangement with creditors, where the commercial activities of the Ten-derer have been discontinued, or where the Tenderer is in a similar situation under a similar procedure under national law in the jurisdiction in which the Tenderer is domi-ciled. If the Tenderer is subject to one of the above grounds for exclusion, the Tenderer will be exclud-ed from participating in the tender procedure. B. Economic and financial standing There are no requirements for economic and financial standing. C. Technical and professional ability The Tenderer must describe minimum 2 similar references within the past three years. “Similar references” in this context means the same or similar model as offered in this tender with the same technical functionalities as requested cf. Appendix 1 – Specification of Require-ments. The three-year period is calculated from the date of submission of the contract notice to TED. Re. documentation of technical and professional ability The Contracting Authority reserves the right to verify that the references were performed.
