Pursuant to section 7(2) of the Danish Consolidation (Act no. 593 of 2 June 2016, as amended) on the Complaints Board for Public Procurement, a complaint must be lodged with the Complaints Board within 45 calendar days after the contracting entity has published a contract award notice in the Official Journal of the European Union. The deadline is calculated from the day after the day when the notice was published. The complainant must inform the contracting entity of the complaint in writing not later than simultaneously with the lodging of the complaint to the Complaints Board for Public Procurement stating whether the complaint has been lodged in the standstill period, see section 3(1) or (2). The procurement is urgent and cannot be conducted through standard competitive procurement procedures without causing an unacceptable delay. A competitive tender would materially postpone the implementation of the required simulation capability and would directly disrupt ongoing and planned training activities. Any delay in implementation would immediately reduce training capacity and the ability to compensate for limited access to physical training facilities, at a time when training output must be increased to meet operational and personnel requirements. The procurement concerns the acquisition of an advanced, fully integrated simulation capability to support military training and education. The requirement includes simulation for dismounted personnel and unmanned systems, as well as capabilities supporting electronic warfare training and the integration of CBRN elements into training scenarios without risk to personnel. These capabilities are required concurrently and must operate within a single, coherent simulation environment. A market assessment has confirmed that only one software solution is capable of meeting the technical, functional, and interoperability requirements in full and within the required timeframe. No other available software products provide a comparable level of maturity, NATO certification, interoperability, and breadth of functionality necessary to support the required training objectives. Alternative solutions would require substantial further development and integration and are therefore not capable of meeting the operational need within the required timeframe. As a result, the contract can objectively only be awarded to a single economic operator. A competitive procedure would not produce effective competition and would result solely in delay without delivering an equivalent capability. On this basis, the conditions for a direct award without prior publication are fulfilled due to demonstrable urgency, technical exclusivity, and the absence of reasonable alternatives.
