Section II: Object
Supplier qualification system (‘SQS’) – contractors for gas pre-heaters and/or gas heat-exchangers within establishment and/or renewal of gas plant installations.
Energinet intends to establish a supplier qualification system (‘SQS’) for the procurement of contractors for gas pre-heaters and/or gas heat-exchangers within establishment and/or renewal of gas plant installations. The SQS is intended for the procurement of Contractors for gas pre-heaters and/or gas heat-exchangers such as the Baltic Pipe project, as well as for other pre-heaters to the Danish gas transmission system.
The SQS consists of supply of gas pre-heaters and/or gas heat-exchangers and/or heat-exchangers.
For further details on the scope of the SQS please refer to the document – Guide to SQS – on EU-Supply.
The contracting authority expect for each project to pre-qualify 3-5 applicants who are evaluated as most qualified for the specific tendered assignment. Only these applicants will be invited to submit a tender.
The selection of tenderers will be based on an assessment of the suppliers technical and/or professional ability and economic standing in relation to the tendered scope of supply. The assessment will be based on the relevant information provided by the supplier in the application for admission to the SQS (including updates).
Applicants should note that commencement of the SQS (first expected call-off for tender) will expectedly be in week 40, 2019.
The Baltic Pipe Project is a European PCI-Project (Project of Common Interest)
Section III: Legal, economic, financial and technical information
Applicants must submit an individual ESPD for each category for which it applies listed in II.2.4) ‘Description of the procurement’.
The applicant must clearly indicate in the individual ESPD which category the ESPD relates to.
Applicants may not be subject to the mandatory grounds for exclusion, cf. the Danish Public Procurement Act (udbudsloven) section 135 (1-3) and 136.
Concerning economic and financial standing:
The applicant must in the ESPD part IV.B provide the following information for admittance to the SQS:
— a positive equity (total equity incl. share capital, reserves, revaluation, retained earning, etc.) in EURO (€),
— equity ratio (equity/total assets) in percent (%).
The contracting authority expects to use the financial data in the ESPD as an important objective criterion when selecting suppliers for future tenders. Thus, it’s of significant importance that the applicants fill in the financial data as detailed as possible.

Concerning technical and professional ability (references):
The applicant should submit 5 references. The applicant should include up to 10 most comparable and relevant references for supplies — listed in II.2.4) ‘Description of the procurement’ — undertaken in the past five (5) years as part of the application. The references must be stated in the ESPD part IV.C: ‘Technical and professional ability’. Undertaken in the past five (5) years implies that the reference must not have been completed prior to the date reached when counting five (5) years backwards from the submission date for application.
All references regarding gas pre-heaters and/or gas heat-exchangers should include:
A specific description of the work performed for each reference, including:
(a) specific responsibilities for the applicant including if applicant has been main contractor;
(b) client and location of project;
(c) contract value (if possible);
(d) component capacity (including barg and Nm3/h capacity);
(e) service (media);
(f) pre-heaters/heat exchanger type (for heat exchanger: TEMA designation);
(g) diameter and pressure rating;
(h) date of initiation and final delivery for work performed by the applicant (day, month, year);
(i) contact information for the entity in question (including contact person);
(j) Technical design drawings.
If the applicant is relying on the references of one or more other entities (e.g. a parent or sister company or a subcontractor) or the applicant is a group of economic operators (e.g. a consortium) the information for the ESPD part IV.C must also be given in a separate ESPD from each of these entities.
The applicant is encouraged to include relevant information a)-j) about the referenced pre-heaters/heat-exchangers, as detailed described as possible, and to provide an overview for the references relevant to information a)-j).
Any ambiguities and/or incomprehensibilities and/or less specification concerning the above information’s, cf. above a)-j), may have a negative effect on the evaluation of the candidate’s suitability. Please note the ‘description’ box can contain more text than is visible. I.e. it is possible to copy paste text into the box.
The contracting authority expects to use the data and descriptions of the references in the ESPD as an important objective criterion when selecting suppliers for future tenders. Thus, it’s of significant importance that the applicants fill in the reference descriptions as detailed as possible.
Concerning technical and professional ability (standards):
In the ESPD part IV.D, the applicant must provide information about certificates and/or descriptions of standards concerning QA and HSE. In this section, the applicant must provide the following information for admittance to the SQS:
— the applicant should under this SQS maintain a quality management system (QMS) in compliance with ISO 9001:2015 ‘QMS - Requirements’ or equivalent or ISO/TS 29001:2011 “Petroleum, Petrochemical and Natural Gas Industries — Sector-specific QMS - Requirements for Product and Service Supply Organisations’ or equivalent for the duration of the SQS.
— the applicant should have implemented and maintain health, safety and environment management systems in compliance with ISO 14001:2015 or equivalent or OHSAS 18001:2007 (or equivalent) or ISO 45001:2018 or equivalent for the duration of the SQS.
The contracting authority expects to use the quality assurance schemes and environmental management standards data in the ESPD as an important objective criterion when selecting suppliers for future tenders. Thus, it’s of significant importance that the applicants fill in the quality assurance schemes and environmental management standards data as detailed as possible.

Energinet is obligated to verify that the applicants are not subject to the mandatory grounds for exclusion. Further Energinet is obligated to ensure that all minimum requirements are fulfilled. Energinet will do so based in the information submitted in the ESPD and the documentation which will be request-ed on the basis of the ESPD.
Applicants must submit ESPD and subcontractor must also submit ESPD.

Complaints regarding a candidate not being pre-qualified must be filed with The Complaints Board for Public Procurement within 20 calendar days starting the day after the Contracting Authority has sent notification to the candidates involved, provided that the notification includes a short account of the relevant reasons for the decision.
Other complaints must be filed with The Complaints Board for Public Procurement within:
1) 45 calendar days after the contracting authority has published a contract award notice in the Official Journal of the European Union (with effect from the day following the publication date);
2) 30 calendar days starting the day after the contracting authority has informed the tenderers in question, that the contracting authority has entered into a contract based on a framework agreement through reopening of competition or a dynamic purchasing system, provided that the notification includes a short account of the relevant reasons for the decision;
3) 6 months starting the day after the contracting authority has sent notification to the candidates/tenderers involved that the contracting authority has entered into the framework agreement, provided that the notification included a short account of the relevant reasons for the decision.
